Terms of Service (“Agreement”)

Please read these Terms of Service (“Agreement”) carefully before using hometrustclub.com (the “Site”), owned and operated by HomeTrustClub (“HomeTrustClub,” “we,” “us,” or “our”). By accessing or using the Site or purchasing leads or services from HomeTrustClub (the “Service”), you agree to be bound by this Agreement. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Services

HomeTrustClub provides marketing and lead delivery services to home improvement businesses and professionals.

HomeTrustClub:

Generates and delivers consumer inquiries (“Leads”).

Does not sell home improvement services.

Does not provide home improvement advice or recommendations.

Does not participate in sales, quoting, estimating, contracting, project management, or service delivery.

All Leads are generated through third-party advertising, landing pages, or data collection methods and are delivered to Clients for their own independent follow-up.

2. Eligibility & User Obligations

By using the Service, you represent and warrant that you:

Are at least 18 years of age.

Are a licensed contractor, service provider, or authorized business entity where required.

Are legally permitted to solicit, market, and sell home improvement-related services in your operating jurisdictions.

Will use the Leads only for lawful business purposes.

You agree to:

Provide accurate and complete account information.

Maintain the confidentiality of your login credentials.

Use Leads only in compliance with applicable laws.

Not resell, redistribute, scrape, or misuse Leads.

Not reverse engineer or interfere with the Service.

3. Licensing & Regulatory Compliance

You are solely responsible for maintaining all required licenses, registrations, certifications, and regulatory compliance in every jurisdiction where you operate.

HomeTrustClub does not:

Verify license status on an ongoing basis.

Monitor contractor or business compliance.

Act as a contractor, builder, or home improvement agency.

We reserve the right to request proof of licensure and to suspend or terminate access for non-compliance.

4. Lead Delivery, No Performance Guarantees & Replacement

HomeTrustClub does not guarantee:

Sales, revenue, or profit.

Conversion rates or contact rates.

Project bookings or contract signings.

Leads are delivered based on availability, targeting criteria, and campaign performance. All Leads are provided “as is.”

We replace all leads no questions asked if they are:

Non-working or disconnected number at time of delivery.

Clearly fake identity, such as obvious profanity or nonsense in required fields.

Duplicate Lead previously delivered to the same Client within a defined period.

5. Consumer Consent & Communications

HomeTrustClub represents that Leads are generated from consumers who have provided consent to be contacted by home improvement professionals.

Prior express written consent, where required.

Consent that clearly names or identifies the specific business or category of sellers that may contact the consumer, consistent with applicable consent standards.

However:

You are solely responsible for TCPA, CASL, CAN-SPAM, and state telemarketing compliance.

You determine how and when consumers are contacted.

You bear all legal responsibility for your communications.

HomeTrustClub is not liable for fines, penalties, or regulatory actions arising from your outreach practices.

6. No Legal, Financial, or Professional Advice

HomeTrustClub does not provide:

Legal advice.

Financial advice.

Tax advice.

Construction, renovation, or project-management advice.

All information provided is for marketing and informational purposes only. You are responsible for consulting qualified professionals as needed.

7. Third-Party Services

The Service may integrate with or rely on third-party platforms such as CRMs, SMS providers, ad platforms, and payment processors.

HomeTrustClub is not responsible for:

Downtime or errors caused by third parties.

Data handling outside our systems.

Third-party terms, pricing, or compliance.

Any agreements with third parties are solely between you and that provider.

8. Intellectual Property

All content, branding, systems, processes, and materials on the Site are the exclusive property of HomeTrustClub and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without written permission.

9. Limitation of Liability

To the fullest extent permitted by law, HomeTrustClub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost revenue.

In no event shall HomeTrustClub’s total liability exceed the amount paid by you for the specific Lead or service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless HomeTrustClub, its owners, employees, contractors, and affiliates from any claims, damages, losses, fines, penalties, legal actions, or expenses, including attorney fees, arising from:

Your use of the Service.

Your communications with Leads.

Your failure to comply with licensing or regulatory requirements.

Any home improvement-related representations or sales activities.

11. Termination

HomeTrustClub reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to conflict-of-law principles.

13. Changes to These Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
